Property Rights


Owning property and determining how it is used is a fundamental right under the US Constitution. The Fourth Amendment says, "The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures shall not be violated."

The Fifth Amendment Takings Clause says that private property shall not “be taken for public use without just compensation.”
